Guidance on employing a young worker

Please be advised that if you are considering employing a person under 16 years of age this must be authorised first by HR.

 

From school leaving age to 18 years of age

 

-        Young people can leave school on the last Friday of June of the school year in which they are 16 years of age. They are classed as a young worker up to 18 years of age.

-        They should not work more than 8 hours a day, or more than 40 hours a week.

-        They should have 12 hours rest between each working day and 48 hours rest between a working week.

-        Whenever the employee works more than 4 and a half hours, they should receive a 30 minute break.

 

 15- 16 year olds (when still in school)

 

     This information is relevant for anyone aged sixteen and under, who has not left school as detailed above.

 

     They must have at least a 1 hour break every 4 hours

 

Term time

During term time young workers can only work a maximum of 12 hours a week. This includes:

     a maximum of 2 hours on school days and Sundays

     a maximum of 8 hours on a Saturday.

School holidays

During school holidays young workers can only work a maximum of 35 hours a week. This includes:

     a maximum of 8 hours on weekdays and Saturdays

     a maximum of 2 hours on Sunday

 

What to do next:

Inform HR of the personal details of any new starter still at school before an offer of employment is made.

Refer to the annual risk assessment in relation to employing young workers and plan according to any additional risks that are identified.
